In Praise of Overzealous Representation -- Lying to Judges, Deceiving Third Parties, and Other Ethical Conduct

Monroe H. Freedman, Hofstra University, School of Law

Monroe Freedman has received the American Bar Association's highest award for professionalism, in recognition of a "lifetime or original and influential scholarships in the field of lawyers' ethics."

Described in the Harvard Law Bulletin as "a lawyers' lawyer," and by the New York Times as "a pioneer in the field of legal ethics," he is frequently consulted by law firms throughout the country. He is the former dean of Hofstra Law School and, for the past 20 years, has lectured twice a year on lawyers' ethics at Harvard Law School. Professor Freedman's first ethics treatise, Lawyer's Ethics in an Adversary System (1975), received the ABA's Gavel Award Certificate of Merit. Reviews have called it "brilliant," a "classic," and one of the few "monumental contributions to legal education in the past generation." His most recent book is Understanding Lawyer's Ethics (3rd ed., Matthew Bender, 2004), written with Georgetown Law Professor Abbe Smith.

Professor Freedman was recognized by The Washingtonian as "one of [the District Columbia's] most highly regarded constitutional lawyers." He was also chosen by Nobel Laureate Elie Wiesel to be the first executive director of the U.S. Holocaust Memorial Council, and has received a Martin Luther King Award for "decades of work to advance human dignity and social justice."

A Silicon Valley icon and philanthropist for the past three decades, Steve Wozniak helped shape the computing industry with his design of Apple's first line of products and influenced the popular Macintosh. For his achievements at Apple Computer, Steve was awarded the National Medal of Technology by the President of the United States in 1985, the highest honor bestowed on America's leading innovators.

In 2000, Steve was inducted into the Inventors Hall of Fame and was awarded the prestigious Heinz Award for Technology, the Economy and Employment for "single-handedly designing the first personal computer and for then redirecting his lifelong passion for mathematics and electronics toward lighting the fires of excitement for education in grade school students and their teachers."

Steve is also a published author with the release of his autobiography, iWoz: From Computer Geek to Cult Icon, in September 2006 by Norton Publishing.

Observations on the Evolution and Future of Mediation

 

 

James C. Melamed founded The Oregon Mediation Center, Inc. in 1983 and has been offering mediation services ever since. Jim is an attorney and recognized national leader in the field of mediation, as well as an adjunct Professor of Mediation at Pepperdine Law School. Jim mediates organizational and legal matters in Oregon, Washington and California and has assisted in the resolution of over 2,000 disputes.

Jim is co-founder and CEO of Mediate.com, former Executive Director of Academy of Family Mediators and former Chair of the Oregon Dispute Resolution Commission. He was also the founding President and first Executive Director of the Oregon Mediation Association and is former Chair of the Oregon Dispute Dispute Resolution Commission.

Jim is recipient of the Association for Conflict Resolution's 2007 John Haynes Distinguished Mediator Award, the Oregon State Bar DR Section's 2006 Sid Lezak Award of Excellence, and the 2003 Oregon Mediation Association's Award of Excellence.
