This policy describes how the Utah State Bar collects, processes, uses, discloses, or shares your information.  When you use our sites, products, or services or otherwise form a relationship with us, we may obtain data from you and the devices you use to interact with us.

This policy describes how the Utah State Bar collects, processes, uses, discloses, or shares your information.  When you use our sites, products, or services or otherwise form a relationship with us, we may obtain data from you and the devices you use to interact with us. This policy is designed to provide transparency into our privacy practices and principles in a format you can navigate, read, and understand. We commit to treating your personal information with care and respect and give you methods to contact us should you have any questions or concerns about the use of your information.

The Scope of this Policy

This Policy describes the processing of information provided or collected on our sites (the “Web Site”) and applications where this privacy policy is posted. In some instances, we may provide additional data privacy notices specific to certain products, practices, or regions. Those terms should be read in conjunction with this policy. If you provide information to us on a third-party site or platform, the information you provide may be separately collected by the third-party site or platform. That third-party site or platform’s privacy practices will govern the use of your information. Choices you make on that third-party platform will not apply to our use of the information we have collected through our sites, products, or services.

Your Privacy Rights

If you are a resident of certain states or countries, you may have the right to know, access, correct, transfer, restrict the processing of, opt-out  from certain types of processing (e.g., targeted advertising, the sale of personal data, limit the use and disclosure of sensitive information, and profiling, as defined by the applicable state law(s)), and delete your personal information. There may be situations where we cannot grant your request (e.g., disclosures based on court rules and regulatory requirements). In such a situation, we will explain our reasoning to you and will honor your right to appeal when applicable.

Information Collected or Processed

In the preceding 12 months, the Utah State Bar may have collected or processed the categories of personal information that are identified below. We generally collect the information listed below to secure, improve, and provide our services to our customers.

Server log information: When you visit the Utah State Bar Web Site, you are identifiable as a unique number, called an IP address. Your IP address is automatically collected in server logs. We use this information to help diagnose problems with our server and to analyze server traffic to learn which pages on the Utah State Bar Web Site receive more or fewer visitors. This information is anonymous and cannot be traced back to a specific individual. The server log also can tell us which browser you are using and the name of the Web Site that referred you to our site.

Session Cookies: When you visit the Utah State Bar Web Site, session cookies are maintained in your computer’s temporary memory. These disappear when your session is over and you close your browser. Session cookies allow users to be recognized within the Utah State Bar Web Site, so user data and selections are remembered within the Utah State Bar Web Site.

User-supplied personally identifiable information: Current and future services on the Utah State Bar Web Site may require that you give us your name, email address, billing and delivery information, credit card or other financial account information, or other personal information. By providing this information, you can and will be able to transact business via the Internet which in the past required telephone or mail contact with the Utah State Bar.

Member Section of Utah State Bar Web Site: Access to the member section of the Utah State Bar Web Site is protected by a password. We recommend that you do not divulge your password to anyone. Members who have logged into the member section of the Utah State Bar Web Site have the option of updating contact information, stating preferences, and making regulatory reports online. These online services are provided as a convenience and allow the Utah State Bar to provide you with efficient and high-quality service.

How We Protect Your Data

The Utah State Bar implements commercially reasonable security measures to help protect against unauthorized access to or unauthorized alteration, disclosure, or destruction of data. The Utah State Bar maintains reasonable administrative, technical, and physical safeguards to protect the confidentiality of information transmitted online. Except for membership directories, membership lists and registration lists, and the sharing of information as set forth in this Privacy Policy, we restrict access to certain companies who need the data to operate, develop, or improve our services or benefits. In some cases, limited data may be made available to volunteer leaders on behalf of the Utah State Bar for purposes such as membership recruitment and retention. Users should be aware that even though protections are in place, the Utah State Bar cannot guarantee against the occurrence of hardware failure, unauthorized or unlawful intrusion, or other technical problems.

Linked Site and Third-Party Providers

The Utah State Bar Web Site contains links to other external Web Sites (“Linked Sites”) that we believe may be useful to Utah State Bar members and the public. The Utah State Bar is not responsible for the privacy practices or the content of these Linked Sites. We may use third-party service providers to help us analyze certain online activities, measure the performance of the Utah State Bar Web Site, and monitor the effectiveness of email communications. For example, these service providers may help us analyze visitor activity on the Utah State Bar Web Site or provide feedback on the effectiveness of our email communications. We may use a third-party service provider to help us efficiently send email communications to members. Aside from member email addresses, we do not share any personal information about members with third party service providers. Our third party service providers are prohibited from sharing, selling or renting member email addresses.

How We Disclose Information

We may disclose your information to our subsidiaries and affiliates, along with our service providers and third-party processors to provide services to you. We may also disclose your information with service providers and third parties when necessary to comply with laws and regulations; respond to subpoenas and court orders; exercise our legal rights or defend against legal claims; investigate, prevent, or take action regarding illegal activities, suspected fraud, potential threats to our property or the physical safety of any person, or violations of our usage instructions and applicable terms and conditions; facilitate the financing or insuring of our business or a disposition of all or part of our business or assets, or as otherwise permitted or required by law. We may disclose anonymized or aggregated data at our discretion, in accordance with applicable laws. The above excludes text messaging originator opt-in data and consent; this information will not be shared with any third parties. If you post your information or content to our online forums or media sites, this information is public on the Internet. We are unable to prevent or control further use of this information and refer you to the third-party sites’ privacy policies and terms of use to learn more about their privacy practices.

Our Commitment to Protecting Information Belonging to Children

Our services are not intended for children under the age of 16. We do not knowingly collect information via our sites, products, and services from users under the age of 16. If you use our Services, you represent that you are at least the age of majority under the laws of the jurisdiction of your place of residence. If we learn that we have collected personal information from a minor, we will promptly take steps to delete such information and terminate the minor’s account.

Cookies and Other Technologies

Cookies are identifiers we transfer to your browser or device that allow us to recognize your browser or device and tell us how and when pages and features in our services are visited and by how many people.
